Temporary Variances

​We can assist you in applying for a temporary variance for certain elevator safety violations, which may extend your time to comply beyond 90 days. 

The temporary variance request allows you to present your case for hardship and obtain a waiver of the code requirements for a reasonable period of time. We process requests for a variance on a case-by-case basis.​

This variance is described in the Technical Advisory Issue 2008-01 of the Florida Department of Business and Professional Regulation's Division of Hotels and Restaurants, Bureau of Elevator Safety (BES). Under contract with BES, we provide local compliance of the elevator safety provisions of Chapter 399, Florida State Statutes and the Florida Building Code.

The most common violations that variances are granted for are:

  • Restricted Opening of Hoistway Doors
    ASME A17.3, Section 2.7.4

  • Car Emergency Signaling Devices
    ASME A17.3, Section 2.7.4 Section 3.11.1

  • Fire Fighter's Service – Phase I & II
    ASME A17.3, Section 2.7.4 Section 3.11.3

  • Car Illumination
    ASME A17.3, Section 2.7.4 Section 3.4.5

  • Single Bottom Jacks
    ASME A17.1, Section 8.6.5.8 (BCID # 9982 and below)

If you are granted a variance, your elevator license will renew in good standing until the upgrades are completed or the extension period expires – whichever occurs first.
