The information provided below is a general summary of the County's requirements for processing agreements. The specific regulations, contained in the Broward County Land Development Code, have been adopted by ordinance of the County Commission and cannot be superseded by this presentation of information. Please consult with staff of the Development Management Division for details.
The Development Management Division processes various agreements that implement conditions of development approval. The major types of agreements include:
•
Impact Fee Agreements which defer payments until prior to the issuance of a building permit.
•
Agreements that amend the note on the plat changing the approved use of the property.
•
Traffic Concurrency agreements which ensure the construction of or payment for road improvements.

All agreements require approval from the County Attorney's Office before scheduling for a County Commission meeting and/or recordation in the Official Records. Certain items must be submitted to ensure that the agreement is legally sufficient. These items include:
1.
A fully executed original agreement with all applicable blanks completed.
2.
An OPINION OF TITLE/TITLE CERTIFICATE rendered within the last thirty (30) days to insure all necessary individuals or legal entities with a property interest, including mortgagee, execute the agreement.
3.
CORPORATE RESOLUTION/PARTNERSHIP AGREEMENT - granting authority to execute agreement, if applicable.
4.
CORPORATE SEAL - if executing party is a corporation.
The Land Development Code gives County staff up to fifteen (15) working days to review standard agreements from the date of receipt. The review time for non-standard agreements may be longer.
The following payments are required after approval of the agreement by the County Attorney's Office and/or the County Commission, if applicable:
1.
A check payable to the Broward County Board of County Commissioners for the applicable application fees based upon the published fee schedule. The fee schedule is available at our office or can be accessed from this web page by clicking on the Application Fee Schedule link which appears at the end of this section.
2.
A separate check payable to the Broward County Board of County Commissioners for recording the agreement in the Official Records. The County Records Division can advise you of the current charges to record documents.
