Elevator Safety Compliance

Temporary Variance for ASME Violations:

The Broward County, Permitting, Licensing and Consumer Protection Division (PLCP) can assist you in seeking a Temporary Variance for certain elevator safety violations, which may extend the time for compliance beyond the 30 days.

The temporary variance request allows a petitioner to present their case for hardship and obtain a waiver of the code requirements for a reasonable period of time. In Broward County, PLCP will process requests for a variance on a case-by-case basis.

This variance is outlined in the Technical Advisory Issue 2008-01 of the Florida Department of Business and Professional Regulation's Division of Hotels and Restaurants, Bureau of Elevator Safety (BES). Under contract with BES, our agency provides local compliance of the elevator safety provisions of Chapter 399, Florida Statutes and the Florida Building Code.

The following violations are typical of those for which a variance may be granted, depending on each individual circumstance:

  • ASME A17.3, Section 2.7.4 - Restricted Opening of Hoistway Doors
  • ASME A17.3, Section 2.7.4 Section 3.11.1 - Car Emergency Signaling Devices
  • ASME A17.3, Section 2.7.4 Section 3.11.3 - FireFighter's Service – Phase I and Phase II
  • ASME A17.3, Section 2.7.4 Section 3.4.5 - Car Illumination 
  • ASME A17.1, Section 8.6.5.8 - Single Bottom Jacks (BCID # 9982 and below)

If your building has received a violation notice and you wish to apply for a variance, you must provide the following:

  • Petition for Temporary Variance from ASME 17.3 - 1996 Edition and  A17.1- 2000 Edition [pdf. form]
  • Inspection report(s) [that indicate the elevator violations]
  • Copy of Proposal
  • Copy of Construction Schedule
  • Copy of signed Contract
  • Letter of Intent to Comply
  • Plan of Corrective Action

Note that if you are granted a variance after our review, as allowed by DBPR through its Bureau of Elevator Safety, your elevator license will renew in good standing until the upgrades are completed or the extension period has ended.
