Flexibility

The Broward County Land Use Plan Future Land Use Map is divided into 125 specific geographic areas known as “flexibility zones.” Within these zones, in accordance with specific circumstances outlined in the Broward County Land Use Plan, a local government can rearrange land uses and residential densities without having to amend the Broward County Land Use Plan.

 

Compatibility Review Process

Policy 13.01.10 of the Broward County Land Use Plan requires that in certain circumstances, the allocation of flexibility after February 2, 1997, is subject to a determination by the Broward County Board of County Commissioners that the rearrangement of land uses or densities is compatible with adjacent land uses and that impacts upon school facilities have been adequately considered. This determination is made through the compatibility review process.

The compatibility review process is administered by the Department of Urban Planning and Redevelopment, Planning Services Division (PSD). There are various provisions and exceptions which apply to the utilization of flexibility. It is suggested that applicants considering the use of flexibility contact the PSD in the beginning stages of the development process.

When a compatibility review is required, the first step in the process is the submittal of a complete application with the PSD. The application form is available at the PSD offices or online. The second step includes a review of the application and development of a staff report by the PSD. There is a $1,700 fee for the review. The final step in the process is an advertised public hearing before the Broward County Board of County Commissioners. The application can be approved, approved as amended, denied or deferred for future study or information. The compatibility review process, usually takes six to eight weeks from application to public hearing.
