Broward County Building Violation.webp

Chapter 9, Broward County Code of Ordinances and Chapter 162, Florida Statutes

All parties may be represented by counsel and shall be given an opportunity to present witnesses and evidence in support of their position. If you do not contest the alleged offense(s), you may elect to arrange a meeting at least seven (7) days prior to the hearing date with the Investigator and execute full payment of the amount due. Please call the Investigator in the violation for more information or to arrange for an appointment. Failure to appear will be an admission of guilt and will result in the enforcement of the fine levied.

Please be advised that if a Notice of Appearance by an attorney is made on your behalf within 10 business days of the hearing or at the hearing, Broward County may request that the disciplinary proceeding be continued at the next available hearing date. You will have the opportunity to call or cross-examine witnesses, present evidence, and offer oral argument.

Any Aggrieved Party, including the Local Governing Body, may appeal a final administrative order of the Hearing Officer to the circuit court. Such an appeal shall not be a Hearing De Novo, but shall be limited to appellate review of the record created before the Hearing Officer. In accordance with Section 162.11 , Florida Statutes, any such appeal must be filed within thirty (30) days of the issuance of the order to be appealed.

If a person desires to appeal any decision regarding any matter considered at these hearings, such person will need a record of the proceedings for such purpose and may need to ensure that a verbatim record of the proceedings being appealed is made (which includes testimony and evidence upon which the appeal is to be based).
