Performing Arts Center Authority

Purpose

Created as an independent special district and a public body, politic and corporate by the Florida Legislature for the purpose of planning, promoting, maintaining, and operating facilities for holding any type of cultural, tourism, or promotional event, civic, recreational, or similar event or activity as a public purpose.

Amended by Chapter 92-268, House Bill 2051, Laws of Florida effective April 11, 1992; increasing the membership from seven to nine members; requiring that of the members appointed by the Broward County Commission and the City of Fort Lauderdale, two shall be minority persons as defined in Section 288.703(3), Florida Statutes.

Amended by Chapter 93-371, House Bill 867, Laws of Florida, effective October 1, 1993; increasing the membership from nine to thirteen members; providing for the appointment of an additional minority person.

Amended by Chapter 2005-335, House Bill 1361, Laws of Florida, effective June 3, 2005; repealing Laws of Florida listed above; re-creating and re-enacting the authority as an independent special district.

Membership

Thirteen (13) members.

(1) Five (5) members shall be appointed at-large by the Broward County Commission, at least one shall be a minority person as defined in Section 288.703(3), Florida Statutes.

(2) Two (2) members shall be appointed by the Commission of the City of Fort Lauderdale.

(3) One (1) member shall be appointed by the Downtown Development Authority of the City of Fort Lauderdale.

(4) One (1) member shall be appointed by the Broward County School Board.

(5) Four (4) members shall be selected by the Broward Performing Arts Foundation, at least one of whom shall be a minority person as defined in Section 288.703(3), Florida Statutes.

Members shall, insofar as practical, be representatives of civic, cultural, recreational, business, and social interests. All members, at the time of their appointment and during the term of their membership, shall be permanent residents of Broward County

Terms

Four (4) years. Members shall serve until a successor is appointed. Vacancies shall be filled for the remainder of the unexpired term. A member may be removed by that governmental unit for just cause by a majority vote of the governmental unit.

Quorum

A majority of the membership.
