Battery Collection and Recycling Program

​​​​​​​​​​​The Broward County Board of County Commissioners have enacted an ordinance regulating the management and disposal of single-use and rechargeable batteries within Broward County.

Who Must Comply?

Q: Does this apply to my business?
A: Yes—if ​​​you sell batteries or rechargeable battery products in Broward County and generate more than $12,000 annually in battery-related revenue.​

What Do I Have to Do?

Q: What is my main responsibility?
A: You must implement an in-store (onsite) battery collection and recycling program for:

  • Specialized Care Batteries
  • Rechargeable Battery Products

This service must be free to customers.

Battery Acceptance Rules

Q: Do I have to accept batteries not purchased at my store?
A: Yes, depending on your retailer type:

  • Large Volume & Repair Retailers: Must accept applicable batteries regardless of brand
  • Small Volume Retailers: Must accept up to:
    • 10 batteries per customer per day (baseline)
    • More if tied to a same-day purchase​

When Must I Accept Batteries?

Q: What are the required collection hours?
A: You must accept batteries:

  • Every day you are open
  • Starting within 1 hour after opening
  • Ending no earlier than 1 hour before closing​

In-Store Setup Requirements

Q: Where do collection containers go?
A: Place them in a:

  • Conspicuous
  • Clearly marked
  • Easily accessible location inside your store​

Handling & Disposal

Q: What do I do with collected batteries?
A: You are responsible for ensuring all collected materials are:

  • Safely handled
  • Properly transported
  • Recycled in compliance with state and federal laws

Signage Requirements

Q: Do I need to post signs?
A: Yes. You must post signage:

  • At store entrances
  • Near battery sales areas

Signs must:

  • Be at least 8.5" x 11"
  • Include required warning language about fire risks and illegal disposal

​Customer Costs

Q: Can I charge customers to drop off batteries?
A: No. Collection must be provided at no cost.​

Can I Set My Own Rules?

Q: Can I limit or control how batteries are dropped off?
A: Yes—but only for:

  • Safety
  • Orderly handling

Rules cannot conflict with ordinance requirements.​

Deadline to Comply

Q: When do I need to be compliant?
A: May 1, 2026

Penalties for Non-Compliance

Q: What happens if I don't comply?
A: Violations may result in:

  • $250 fine (first violation)​
  • $500 for repeat violations
  • Each day may count as a separate violation

  • Batteries cannot be disposed of in trash or standard recycling
  • Improper disposal can cause fires and safety hazards
