Unsafe Structures Board

Purpose

Hear and determine appeals from actions and decisions of the Building Official of the Broward County Building Code Services Division.

Hear and review the application of the Building Official for review of his/her action where the his/her decision, as indicated in a Notice of Violation has not been complied with.

Affirm, modify or reverse the decision of the Building Official upon appeal or on application for review.

Hear and determine appeals from actions and decisions of the enforcing agency pursuant to the provisions of the applicable Minimum Housing Code.

Ordinance #74-18, enacted November 12, 1974, adopting a Minimum Housing Code; including the Minimum Housing Board of Appeals with authorization to act as the Unsafe Structures and Housing Appeals Board.

Amended by Ordinance #76-55, enacted October 12, 1976, revising the Minimum Housing Code; revising the Minimum Housing Board of Appeals.

Amended by Ordinance #76-56, enacted October 12, 1976, repealing Sections 5-52 through 5-66 of the Broward County Minimum Housing Code.

Amended by Ordinance #88-74, November 8, 1988, adding Sections 5-54 and 5-70 of the Broward County Minimum Housing Code.

Broward County Ordinance #1998-43, enacted November 24, 1998, amending Section 5-53 through 5-71 of the Broward County Housing Code; deleting The Minimum Housing Board of Appeals; authorizing the Unsafe Structures Board, created by Section 202.13 of the South Florida Building Code, to act as the Unsafe Structures and Housing Appeals Board, pursuant to Chapter 553, Florida Statutes.

Amended by Ordinance #2005-02, enacted January 11, 2005, updating the name of the authority under which the board hears cases and is maintained from the South Florida Building Code to the Florida Building Code (Chapter 553, Part IV, Florida Statutes).

Pursuant to The Florida Building Code, Broward County Amendments, effective March 1, 2009.

Retained by Ordinance #2009-25, effective May 6, 2009, after a sunset review of its performance as required by Section 2.09 of the Broward County Charter.

Membership

Nine (9) members appointed at-large by the Broward County Commission representing all of the following categories:

1) Registered engineer;

2) Registered architect;

3) General building contractor;

4) Electrical contractor;

5) Attorney at Law;

6) Plumbing contractor;

7) Real estate appraiser;

8) Real estate property manager; and

9) Citizen with experience and background in the social problems.

All professional members should be registered and licensed in the State of Florida.

Members shall be permanent residents of the area of the jurisdiction of the Broward County Commission who possess outstanding reputations for civic activity, interest, integrity, responsibility and business or professional ability.

DUAL OFFICEHOLDING:

The Florida Constitution prohibits a person from simultaneously holding more than one office under the government of the state, counties, and municipalities. The prohibition applies to both elected and appointed offices. It is not necessary that the two offices be within the same governmental unit.

Terms

Three (3) years. Members shall continue to serve until a successor is appointed. Vacancies shall be filled for the remainder of the unexpired term.

Five (5) members.
