Consumer Protection Board

Purpose
Enforce consumer protection safeguards; issue and enforce cease and desist orders; hold hearings, take testimony under oath in all matters relating to consumer protection; revoke or suspend occupational licenses.

Meet in its capacity as the Broward County Drug, Prostitution, and Criminal Street Gang-Related Public Nuisance Abatement Board when hearing public nuisance abatement matters.

Promote, protect, and improve the health, safety, and welfare of the residents of Broward County by providing an equitable, expeditious, and effective method to abate the use of property within Broward County for the unlawful sale, delivery, manufacture, cultivation, and felony possession of any controlled substances, and to abate prostitution-related public nuisances and criminal street gang-related activities.

Pursuant to Broward County Charter, Article I, Section 1.04 (o).

Ordinance #81-77, enacted August 11, 1981, designated as the Broward County Consumer Protection Code; creating the Consumer Protection Board, which act was approved by the voters of Broward County at a referendum election held November 1980; granting all necessary powers to the board as accorded by Chapter 80- 463, Laws of Florida, previously derived from the following ordinances: 77-16, 78-414, 79-15, 79-36 and 81-63.

Amended by Ordinance #82-37, enacted July 15, 1982, increasing the membership of the board; providing that members serve in accordance with Section 1-233, Broward County Code.

Amended by Ordinance #86-23, enacted May 19, 1986, deleting the requirement that three board members must be mobile home park owners and three board members must be mobile home park residents.

Amended by Ordinance #86-67, enacted December 9, 1986, defining hearing examiner as a consumer protection board panel.

Amended by Ordinance #89-28, enacted July 11, 1989, reducing the time the board may modify or set aside its order.

Amended by Ordinance #90-16, enacted July 10, 1990, providing for additional powers of the board.

Amended by Ordinance #1997-28, enacted July 8, 1997, providing for additional functions, powers, and authority of the board.

Amended by Ordinance #1999-22, enacted May 25, 1999, requiring members to volunteer to serve on four (4) hearing panels per calendar year.

Amended by Ordinance #2001-06, enacted February 13, 2001, reducing the membership from twenty-one to eighteen.

Amended by Ordinance #2009-37, enacted June 23, 2009, transferring the roles and responsibilities of the Broward County Drug, Prostitution, and Criminal Street Gang-Related Public Nuisance Abatement Board to the Consumer Protection Board; hearing public nuisance matters abatement matters pursuant to Chapter 20, Article VII, of the Broward County Code of Ordinances; and providing that the Consumer Protection Board shall have jurisdiction in the unincorporated areas and in municipalities which have entered into a public nuisance abatement interlocal agreement with the County.

Membership

Eighteen (18) members.

Each Broward County Commissioner shall appoint two members who are registered voters.

Each member shall volunteer to serve on at least four (4) hearing panels each calendar year. Failure of any member to serve shall be cause for that member’s removal from the board.

DUAL OFFICEHOLDING:
The Florida Constitution prohibits a person from simultaneously holding more than one office under the government of the state, counties, and municipalities. The prohibition applies to both elected and appointed offices. It is not necessary that the two offices be within the same governmental unit.

Terms

Section 1-233 of Chapter 1, Article XII, Broward County Code of Ordinances , as may be amended from time to time.

Quorum

A majority of the total appointed board members.
